| Second degree rape trial begins |

She says she rejected his advances and told him "no." He says it was consensual. Now, a Pennington County jury must decide who's telling the truth.
The trial started Tuesday for Matthew E. Davis of Winner, who's charged with second degree rape. During opening statements, the prosecution said Davis forced himself on the alleged victim while the two were at the home of a mutual friend one night last December then told contradicting stories to a detective investigating the allegation. The defense said Davis's accuser asked if he wanted to fool around and said she never contacted police. Law enforcement was called three days later by the hospital, after she went to the doctor to get a lesion checked and told someone there that she was sexually assaulted. If he's convicted, Davis faces up to 50 years in prison and a fine. |
